These terms and conditions set out the basis on which you can use our website and place orders for items from Next Directory. By ordering goods from Next Directory you are deemed to have understood and accepted these terms. The supplier of the goods featured is Next Directory, a trading name of Next Retail Limited and part of Next Group Plc, ("Next", "we", or "us"). You may phone us on 0844 844 8000. Telephone calls to and from Next Directory may be recorded or monitored as part of our efforts to further improve service to our customers. Unless stated otherwise, all calls to Next cost 5p per minute from a BT landline, charges from mobile providers and other networks may vary.

We may contact you for marketing purposes by email, mail or telephone with relevant offers from the following Next Group Companies: Next Retail Limited and Lipsy Limited. We may also contact you for market research purposes.

When you apply for a Next Directory Flexible Account (“Next Account”) and your application is accepted, a Next Account will be opened for you. To hold a Next Account you must be over 18 and a UK resident. A Credit Agreement will be sent to you and you must read this carefully, (together with the other information we will send you) sign both copies and return one copy to us. Next reserves the right to withhold all orders until it receives a signed Credit Agreement from you. The Terms and Conditions governing your use of a Next Account will be set out in the Credit Agreement.
The Next Directory will be sent to you twice a year while you remain an active customer of Next Directory and you will be charged £3.75 for your first and each subsequent season that you receive a copy of the Next Directory. The charge for your Directory covers the Main Directory for that season, and all mid-season brochures, or other publications that we may send to you that season. We will notify you before we send any additional publication allowing you the opportunity to cancel it. You understand that a Next Directory Card may be issued to you to allow you to use your Next Account in store to purchase items. The issuing of a Directory Card is subject to the way in which you manage your Next Account. Purchasing goods with your Directory Card is subject to the credit limit of your Next Account, which is variable. Next reserves the right to alter or amend credit charges, to withdraw credit, to accept or reject orders, to refuse applications, or on two months prior notice to close an account. To prevent identity fraud you may be required to confirm your identity when placing an order on your Next Account. A payment up to the value of the order may be requested using a credit or debit card registered to the account holders address. The rest of the order will be invoiced at a later date.

To open an Account for you, we will make searches about you at credit reference agencies who will supply us with credit information, as well as information from the Electoral Register. The agencies will record details of the search, which can only be seen by you and Next on your credit file, whether or not credit is granted. If we are unable to offer credit or you choose to use the credit we offer the credit reference agencies will also record a search which will be seen by other lenders. We may use credit scoring methods to assess your application and to verify your identity.
Credit searches and other information which is provided to us and/or the credit reference agencies, about you and those with whom you are linked financially, may be used by Next and other companies if credit decisions are made about you or other members of your household. This information may also be used for debt tracing and the prevention of money laundering as well as the management of your account. Information held about you by the credit reference agencies may already be linked to records relating to people with whom you are linked financially. For the purposes of credit searching you may be treated as financially linked and you will be assessed with reference to any "associated" records.
If we enter into a credit agreement with you, we will also supply details of your agreement with us to the credit reference agencies, as well ongoing details of your account and how you manage it. If you do not repay on time, or in full, we will advise the credit reference agencies who will record details of the debt. All this information will be seen by other organisations carrying out later searches. The credit reference agencies may also use the records for statistical analysis about credit, insurance and fraud.
You have the right of access to your personal records held by credit reference agencies and we will supply their names and address upon request to the Data Protection Manager, Next Directory, Desford Road, Enderby, Leicester, LE19 4AT or via dataprotection@next.co.uk.
We may make periodic searches of Group records and credit reference agencies to manage your Next Account, to take decisions regarding credit, including whether to make credit available or to continue or to extend existing credit. These searches will not be available to other lenders for credit assessment purposes. We may also use your information, including shopping habits, to open and run your Next Account including payment recovery, fraud prevention and debt tracing and for our marketing.
Some of the information you provide may be transferred outside the European Economic Area for processing. However, strict rules regarding the confidentiality of security of your information are in place to safeguard it.

Purchases from the Next Directory including transactions on your Directory Card in store will be charged the day after the goods are despatched/purchased in store.

You will receive a statement every month detailing your purchases unless you have not placed an order or there is no outstanding balance. Your statement will show:
- What we have sent you since your last statement
- The payments we have received from you
- The outstanding balance
- Your minimum payment and the date this is due
- Your current credit limit and the balance available to spend

Your account will be subject to a credit limit which we may vary at any time (up or down). The outstanding balance of your account must not exceed your credit limit. If you exceed your credit limit you may be asked to pay the excess immediately. Your credit limit will be shown on each statement.

A Next Account allows you to spread the cost of purchases (subject to status and approval). APR 25.99% (variable). You must make a payment every month of at least the minimum payment shown on your statement. You can choose to pay more if you want to, up to the full balance. If you only pay the minimum payment it will take longer to repay the balance and you will pay more overall. Missing a payment could have severe consequences and make obtaining credit more difficult. Payments that we receive from you will be allocated to your Next Account in the following order
- payment of all default charges shown on the latest and any previous statement;
- payment of all interest charges shown on the latest and any previous statement
- towards payment of the purchase price of all goods and/or services shown on the latest statement;
- towards payment of the purchase price of all goods and/or services shown on any previous statement.

Only items purchased from Next Directory are eligible for return via a Payzone return zone. Items returned via a Payzone return zone will be credited to your Next Directory account and will appear on your statement within 2 working days (subject to connectivity between Next and Payzone). If you have a Next Directory account and have purchased Next Directory items using a debit or credit card any refund due for that order will be applied to your Next Directory account and not the card used for payment. If you are a non Next Directory account customer and have purchased Next Directory items using a debit or credit card, the refund will be credited to the card used within 2-3 working days. Network connectivity may cause delays in returns being credited to your account immediately. To return items you will need the original despatch note which details the item, without this the return will not be actioned. Items must be returned in a new and unused condition. Specific packaging or despatch bag are not required, but the items should be in their original plastic outer, wherever possible. You will receive proof of return from the Payzone outlet. Payzone return zones will not accept the following Next Directory items for return: large or bulky items, 2 man delivery items and products for return at Next Bathrooms, Next Fitted Kitchens, Hammonds, Photos, Domestic Appliances, Art2Order, Green Retreats, Made2Measure, Flooring, Wine, Gift List, Gift Cards, eVouchers, Flowers, House Signs, Garden Plants, Conservatories, Windows, Doors & Shutters, Magazines & Experience websites. We will calculate your minimum monthly payment by adding together the total outstanding balance on your account and the total service charge that you would pay over 12 months on that balance, your minimum monthly payment will be 1/12th of the total or £5, whichever is the greater. If, however, your outstanding balance is less than £5 you will only have to pay your outstanding balance. Your minimum monthly payment will be recalculated in the same way whenever there is a change in the outstanding balance of your account (e.g. further goods are charged to your account, you return goods, or you make a payment).

The taking of payment from you by Next under any of the means set out below or in accordance with the Next Account does not indicate that a contract has been formed between you and Next. By placing a telephone order or by completing and submitting the electronic order form including your payment details you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. Payment will be refunded to you if your offer is later refused or rejected by Next. By credit & debit cards
We accept all major credit and debit cards. The card must be registered to the address where your Next Account is held.
We are unable to accept cards that are due to expire within the next 5 days. Card details are checked and verified by a third party and goods are despatched once authorisation has been obtained.
By Next Gift Card
You can either call SelfServe on 0800 587 7758 with your SelfServe number, or redeem your Gift Card online. You will need to key in the Gift Card number shown on the back. You can use the full or part balance on the card to make a payment. You cannot use refund or Euro cards to pay your account.
By Payzone
To pay your account you will need your printed statement, without the statements payment will not be accepted. This service is available in selected areas only. To check the location of your nearest Payzone outlet please see www.payzone.co.uk/Store-Locator. Only charges appearing on statement are eligible for payment via a Payzone outlet. Only cash payments are accepted.

Our service charge is 25.99% APR (variable). If you do not pay your full balance in any month by the date stated, the service charge will be added as follows:
- on purchases from Next Directory and the delivery charge shown on your statement, from the date your goods were sent to you; and
- on purchases from Next Group Plc stores using your Next Directory Card, purchases of gift vouchers or gift cards on your account and any warranties, from the date of purchase; and
- on wine and flowers, from the day after despatch; and
- on any delivery, collection, installation and removal charges for Domestic Appliances, from the day after your goods were sent to you, installed, or collected from you; and
- for your copy of the Next Directory, from your statement date; and
- on a deposit for any made to order items, from the date it appears on your statement and on the balance , from the day after delivery to you; and
- on any outstanding balance from your previous statement which is brought forward to your current statement; and
- on brown and white goods (including washing machines, tumble dryers, combined washers and dryers, fridges, freezers and ovens) from 14 days after the date of your order.
Any part payment made by you will be taken into account when calculating the following month's service charge. Our service charge is calculated on a daily basis on the outstanding balance of your account. If you do not pay your account balance in full by the date shown on your statement, the service charge will be charged on your outstanding balance from the date of your last statement. You will not be charged any more service charge than has previously been added to your account if we receive payment of the full outstanding balance by the date shown on your statement.
In calculating the APR we have not taken into account any changes which we may make to our service charge, or any other changes which enter into the calculation of the APR. We may introduce or vary the service charge rate or such charges at any time, by giving you at least 28 days' written notice.
- By way of example, if purchases were made up to a credit limit of £300 and repayment was made over 12 months by 12 equal payments and the service charge remained the same throughout the period the total charge for credit would be £38.92.

If you fail to make the minimum payment by the date specified on two successive statements you will be charged an administration fee of £7.50 which will be added to your account and will show on your next statement. If you send us a payment and it is returned unpaid we will charge you £5.50.

The issuing of a Directory Card is subject to the status of your account.
Purchasing goods with your Directory Card is subject to the credit limit of your Account, which is variable. Store transactions will be charged to your account normally within 1 day of purchase, returns will normally be credited to your account on the next working day. Items will be detailed on your account statement.

Theft, Loss or Misuse of the Directory Card
If your Directory Card is lost, stolen, or misused by someone without your permission, you may have to pay up to £50 of any loss to the creditor. If it is misused with your permission you will probably be liable for ALL losses. You will not be liable to the creditor for losses which take place after you have told the creditor about the theft etc. as long as you confirm this in writing within 7 days.

Customers Without a Next Directory Account
Customers without a flexible Next Directory account can pay for items as they are ordered by credit or debit card. The remainder of the terms and conditions set out below will then apply.

Orders and Contract Information
Your order is accepted and a contract is formed between Next and you when we despatch the goods you have ordered and not before. A contract is not formed at the point in time that payment has been taken from you by Next, nor at the point in time that you receive an email from Next acknowledging receipt of your order. Until the goods are despatched the order may not be accepted by Next or may be cancelled by you. Exceptions apply to orders for personalised items and goods made to your order which cannot be cancelled by you once you have received email confirmation that your order has been received, as such items and goods may already be in production as a result of your order. For a full list of exceptions please see under the heading EXCEPTIONS TO THE RETURNS POLICY. For security reasons, until you have placed an order for goods, received your first statement and a payment has been received for those goods, you will be unable to order giftcards/e-vouchers, ask for delivery to a store or to an alternative address. For security reasons we may restrict the volumes of certain items to be sold in any one transaction.
Following formation of the contract, Next shall continue to own any goods ordered until it has received payment in full from you even though the goods may have already been delivered to you.

Our delivery charge to mainland UK is just £3.99 per order no matter how large your order, with the following exceptions: fresh flowers £3.99 per bouquet, wine £3.99 per box, personalised picture gifts £3.99 per item, gift cards and vouchers £2.00 per delivery, large domestic appliances £19.99 per item, digital photos £1.50 per order and photo gifts up to £7.50 per order, charges will be detailed at point of order. Delivery charges for flooring depend on the weight and size of order and will be detailed at the point of order. We do not deliver fresh flowers or wine outside mainland UK, this includes to BFPO addresses.

The next day delivery service applies on orders placed before 10pm Sunday - Friday. Orders placed on Saturday will be delivered on Monday. The next day delivery service is only available in our personal courier areas and is subject to stock and courier availability and demand. When the personal courier service is not available, Next will deliver by an alternative carrier and this may take longer. It is not applicable to Postal Flowers, Wine, items ordered from the Gift List, Gift Cards, Art 2 Order, Personalised Gifts, Photo Processing, Bathrooms Suites, Carpets, Flooring, Gift Experiences, House Signs, Made2Order, Magazines, Next Entertainment, fitted bedrooms by Hammonds Space are excluded from the personal courier and next day delivery service Domestic Appliances can be delivered next day but a surcharge applies. Premium Delivery Services
SUNDAY COURIER DELIVERY SERVICE Sunday delivery service applies on orders placed anytime up until 10pm on Saturdays for delivery between 10am and 4pm.
SAME DAY COURIER DELIVERY SERVICE Same day delivery service applies on orders placed Monday - Friday before 12 midday (or before 11am on a Friday), for delivery between 6.00pm and 9:30pm Monday to Friday.
EVENING COURIER DELIVERY SERVICE Evening delivery service is available for delivery between 6.00pm and 9:30pm Monday - Friday. Orders can be placed up to 7 days in advance, and must be made by 12 midday for delivery same day (or before 11am on a Friday).

Fresh Flowers & Wine Only
Most fresh flower orders placed before 7pm can be delivered the next day. Flowers ordered between 7pm Friday and 7pm on Saturday will be delivered Monday and orders after 7pm Saturday and 7pm Monday will be delivered on Tuesday. Flower deliveries will occur between 7am and 7pm. Most wine orders placed before 4.30pm can be delivered within 48 hours. No deliveries are made on Bank Holidays or the day following a Bank Holiday. You will be advised of delivery availability at time of order. Orders for alcohol can only be taken from those over 18 years of age. Flower and wine orders are not returnable, for refunds on a faulty item please phone 0844 844 8050.

Delivery to stores is free and will take 4-5 working days. This service is available in over 400 Next Stores but is not available for orders made on a Next Account until you have received your first statement and you have made a subsequent payment, for made to order items, digital photos and photo gifts, fresh flowers or selected large/bulky items. Please take one form of personal identification e.g. driving license or utility bill and either your Directory Card, statement, delivery note or letter accompanying your Directory. We will email you when your order is ready for collection at your designated store.

Express Next Day to Store delivery
Delivery will cost £0.50 per order for collection on the stated delivery day after 12:30pm on a Monday to Saturday or 4pm on a Sunday. If you cancel or return your order this cost will not be refunded unless the product is faulty or does not fit the description given. For the most up to date cost please visit next.co.uk/terms. The express next day to Store delivery service applies to orders placed before 6pm on any day. Delivery times cannot be guaranteed. It is only available in selected stores and is subject to stock availability and demand. Delivery is not available on a bank holiday or during the sale period. Non-collection from Store Administration Fee
Orders delivered to stores that are not collected within 14 days of the collection date will be returned to the warehouse and a refund processed. There will be a parcel not collected admin fee of £1.75 for orders not collected within 14 days and if the order was paid for using your Next Account the Next Account will be charged accordingly. For orders paid for by credit and debit card, the charge will be deducted from the refund.

Express 4 Day Delivery (Furniture and Sofas)
Products on the express delivery will be delivered to your home within 4 working days. If your order consists entirely of 4 day delivery items furniture or sofas and they are in stock then you will be offered a delivery date within 4 working days. If all your items are on the 4 day express delivery service you will be offered 1 date within the 4 day slot otherwise the delivery will be outside this lead time. If the first delivery date you are offered is out of the 4 working day period then contact the customer services team on 0844 844 8027.
Note: The 4 day delivery offer is only available in core delivery areas covered by Next delivery fleet. Please check on ordering. Out of the core delivery areas you will be offered the first available delivery slot. Customers ordering one or more items in an order will only be charged once.

Send To A Friend Delivery Service T&Cs
Our ‘Send to a Friend’ delivery service is available only to Next Directory credit account holders.
The service allows orders to be delivered to the account address as well as up to 5 other addresses. Additional delivery addresses can be added to your Account either during checkout or by logging into ‘My Account’ and selecting the ‘Delivery Address’ option. (Unfortunately we are unable to deliver to workplace addresses). After the new address details have been entered we will ask you to authenticate the new address against your billing address by entering your credit card details (the credit card must be registered to your billing address). We will not take any payment from the card and the information will not be stored by us, it is simply used as a security check.
Once you have completed this step you can start delivering items to an alternative address. To enable us to deliver to a different address to your ‘Account Address’ we will require you to pay by credit card for your order when you checkout. The credit card must be registered to the Account Address.
Gift Cards or eVouchers cannot be used for goods purchased and delivered to an alternative delivery address for security reasons.
In the instance that part of the order is delivered to a store and part is delivered to a new address, the order will still need to be paid for in full by credit card.

Under the Consumer Protection (Distance Selling) Regulations 2000 you have the right to cancel your order within a period of 7 working days. The period of 7 working days begins on the day after the day you receive your goods. Please be aware that your right to cancel does not apply to certain goods that we sell, for example, items made to your order, such as photo gifts and made to measure curtains, fresh flowers, food items, toiletries and cosmetics, or pierced earrings. You must inform us of your wish to cancel in writing either by letter or email within a period of 7 working days. The period of 7 working days begins on the day after the day you receive your goods. You must take reasonable care of the goods and not use them. You should return goods to us in their original packaging, wherever possible, as soon as possible after informing us of your wish to cancel. If you return goods to us, we will not be responsible for any loss or damage to them during transit and we recommend that you use a recorded or secure delivery method. If goods are lost or damaged in transit, we may charge you, or not refund to you, amounts that are attributable to the loss or damage.

Fresh flower cancellations and changes are possible up to 48 hours prior to delivery.

Returns for items on your next account
You may return most items, in a new and unused condition and wherever possible in the original packaging by:
a) Returning to a Store
This service is available in all Next stores except our airport stores and is free of charge. If you are returning an item via a store, please take your delivery note with you. For details of your nearest store please call 0844 844 8939 or log on to www.next.co.uk/storesearch.asp. Certain items cannot be returned to stores, as detailed below in Exceptions to the Returns Policy; or
b) Our Courier
To make a return by courier, contact your courier direct (they will leave a number with the delivery), or call 0844 844 8000, or contact us via SelfServe, or online to arrange for your courier to collect the items from your home. Items left for the courier to collect are left at your own risk. There is a charge of £3.99 for this service if you return all items ordered in one transaction. This will be applied on the return of the final item from a single order, if items are not returned at the same time; or
c) Post
To return by post call 0844 477 4874 to request a returns label, then take to your nearest post office.

Returns for Customers paying by Debit or Credit Card
Returns to store are free of charge. Please see Exceptions for items which cannot be returned to stores. Returns via our courier are charged at £3.99 per collection. Simply call 0844 844 8000 to arrange for a courier to collect the items from your home. Items left for the courier to collect are at your own risk. To return by post contact 0844 477 4874 and we will send you a label. Any charges will be deducted from your credit/debit card prior to any refund. If a Customer with a Next Account pays for an order by debit or credit card any refund due for that order will be applied to their Next Account and not the card used for payment.

Exceptions to the Returns Policy
The following items are not included in our standard returns policy. We cannot accept any returns through our airport stores. We are unable to accept the return of large bulky items, domestic appliances or copies of the Next Directory through our stores. A non-refundable collection charge of £30.00 will be applied to large furniture items if delivery is refused, or collection is requested, unless the product is faulty or does not fit the description given. No refunds or exchanges can be given on items made to your specification, such as sofas, digital photos and photo gifts and made to measure curtains, or on either sample pots, or full size pots of paint unless there is a manufacturing defect or the goods are not as ordered. For hygiene reasons, certain jewellery items, cosmetics and grooming products, mattresses, divans, duvets and pillows cannot be returned if unwrapped unless faulty. Self assembly furniture cannot be returned part assembled. Perishable items such as food, drinks and fresh flowers cannot be returned. Where a product has a security sticker warning that the product cannot be returned once the sticker is removed, a refund or exchange will not be given if the seal is broken except in accordance with your legal rights. Gift cards/vouchers cannot be returned or exchanged for cash. Returned items which are not in new or unused condition may not be credited to your account unless they are faulty.

Closing your Next Account
If you want to cancel your Directory Account you will need to confirm this in writing to us at the following address Next, PO Box 4000, Sheffield, S97 3ET or call 0844 844 8000#. You will need to tell us your name, address and Account Number. If you decide to cancel your Account you will need to pay for any items that you have received or return them to us in a new condition. You will also need to return the Next Directory. Please call 0844 844 8000 to arrange this. If you do not exercise your right to cancel, this agreement will remain in force and effect and its terms and conditions will bind you.
Your Next Account will continue unless you or we decide to close your Account. We have the ability to do this at anytime at our discretion. You can close your Account at anytime by writing to us (including your name, address and Account number) at Next, PO Box 4000, Sheffield, S97 3ET. If you close your Account you will have to pay any outstanding balance on your Account immediately. If you do not use your Account for more than 2 years we will close your Account automatically.

Customer Ratings And Reviews
These Terms of Use govern your conduct associated with the Customer Ratings and Review service offered by Next (the "CRR Service"). To the extent of any conflict between our Privacy Policy and these Terms of Use, these Terms of Use will take precedence in respect of the CRR Service.
By submitting any content to Next, you represent and warrant that:
- You are the sole author and have not copied the content from any third party;
- All content that you post is accurate;
- Use of the content you supply does not violate these Terms of Use and will not cause injury to any person or entity.
You further agree and warrant that you shall not submit any content:
- That is known by you to be false, inaccurate or misleading;
- That infringes any third party's copyright, trademark, or privacy;
- That is, or may reasonably be considered to be, defamatory, racially or religiously biased or offensive, contains obscene language, or is threatening or harassing to any individual, partnership or corporation;
- That includes any information that references other websites, addresses, email addresses, contact information or phone numbers; or
- That contains any computer viruses, worms or other potentially damaging computer programs or files.
For any content that you submit, you grant Next a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.
All content that you submit may be used at our sole discretion. We reserve the right to change, condense or delete any content on our websites that we deem, in its sole discretion, to violate the content guidelines or any other provision of these Terms of Use. We do not guarantee that you will have any recourse through Next to edit or delete any content you have submitted.
Ratings and written comments are generally posted within two to four business days. However, we reserve the right to remove or to refuse to post any submission for any reason. You acknowledge that you, not Next, are responsible for the contents of your submission.
None of the content that you submit shall be subject to any obligation of confidence on the part of Next, its agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees.
By submitting your email address in connection with your rating and review, you agree that Next and its third party service providers may use your email address to contact you about the status of your review and other administrative purposes.

In order to buy an eVoucher you must have a Next Directory Account. A recipient of an eVoucher must have a valid email address. It’s possible to receive an eVoucher without having a Next Directory Account but it is not possible to redeem the eVoucher online without an Account.
You can book delivery of the eVoucher up to 60 days in advance but payment will be taken immediately.
Please remember to enter the receiver’s email address carefully as we cannot be held responsible if the address is entered incorrectly and someone other than the intended receiver uses the eVoucher. Once you have placed your order online we cannot change the receiver’s email address, cancel or issue a refund for your eVoucher.
Your eVoucher can be used by you if you are the purchaser or it is given to you as a gift. As Next Photo Art is made-to-order to your requirements no refunds or exchanges can be given unless your instructions have not been carried out or the item is found to be faulty. Your legal rights are not affected. The quality of the final product will depend on the quality of the original image sent. Some colour variations may occur in reproduction. You must ensure that you own the rights to the image that you submit and that you have obtained any relevant permission to use it in this way. Next reserves the right to not print any image which it considers unsuitable or which may cause offence.

Digital Photos and Photo Gifts
Next's liability to you in respect of your order (including in respect of delayed, corrupted, damaged and lost orders) is limited to the value of the order. If the images you submit are of value, or you are using the service for business purposes, such that, in the event your images were damaged, destroyed or lost, your loss would exceed that amount, you should take out the appropriate insurance at your responsibility. Your legal rights are not affected.
We recommend that before submitting digital images to us you retain a copy for yourself to use in the unlikely event of your images being lost or corrupted. In particular, whilst the web album service is intended to provide a convenient way of grouping your images and sharing them with others, it is not intended as stand alone depository for your images and you should not rely on it as such. You should always retain your own copies of all images uploaded.
Delivery of prints
All prints will be delivered to the delivery address supplied by you during the registration process. Your order will be accepted upon Next notifying you by email that your order has been accepted and has agreed to supply the prints, greetings cards and/or photo gifts to you.
Time for delivery of photos and photo gifts is an estimate only and it is not a condition of this agreement.
Returns and cancellations
You hereby consent to the Next photo printing services commencing immediately and as such you will not have a right to cancel your order. However, in the event that you are unhappy with any aspect of our online print services, you will be entitled to send the prints back to Next within 28 days of receipt whereupon Next will provide a full refund of the purchase price. Due to the personalised nature of photo gifts and greetings cards, we are unable to offer refunds on these items, except where we are required to do so by law. Intellectual property rights
You warrant that you are the owner of the copyright in any material that you send to us for reproduction.
Liability
Without prejudice to the first paragraph of the Digital Photos and photo gifts section, (general liability statement) above, Next's liability to you shall be limited to the sum of £50 for any one incident or series of related incidents and up to a total of £100 for all incidents in any period of twelve months.
Without prejudice to the first paragraph of the Digital Photos and photo gifts section (general liability statement) above, Next shall not be liable for any economic loss, profits or anticipated savings, any loss of goodwill and reputation or any loss of data or any consequential loss as a result of breach of contract and/or negligence.

Cancellations
Framed Items - As all framed items are custom-made to order, cancellation is not possible after the order has been placed and accepted. Framed items are custom-made and may only be returned if faulty or not as described.
Unframed Items - Under the Consumer Protection (Distance Selling) Regulations 2000 you have the right to cancel orders containing only unframed items within a period of 7 working days. Please be aware that your right to cancel does not apply to items made to your order. You must inform us of your wish to cancel in writing either by letter or email within a period of 7 working days. The period of 7 working days begins on the day after the day you receive your goods. You must take reasonable care of the goods and not use them. You should return goods to us in their original packaging, wherever possible, as soon as possible after informing us of your wish to cancel. If you return goods to us, we will not be responsible for any loss or damage to them during transit and we recommend that you use a recorded or secure delivery method. If goods are lost or damaged in transit, we may charge you, or not refund to you, amounts that are attributable to the loss or damage.

Returns
Unframed items may be returned for refund up to 10-working days from receipt of goods.
If you wish to arrange for goods to be returned, please contact customer services on 0844 414 1316 quoting your order number and reason for return. Instructions on how to return your order to us will be provided. Once we receive the returned product, we will replace or refund as required.
Please note:
- Goods must be returned in good condition, carefully repacked in the original packaging.

Refunds

Descriptions of goods and services included in the Art2order site are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. Additional Terms & Conditions of Sale for Next Experiences Only
The Next Experiences issues face value vouchers ("Vouchers") entitling the Holder to choose, up to the value stated on the Voucher, one of a range of activities supplied by the Next Experiences and provided by selected suppliers.
Voucher Validity
Vouchers are valid for a minimum of nine months (excluding promotions). Please check the season of any intended activity, as this may be shorter than the Voucher validity. You will find the expiry date printed on the Voucher. You must book and complete your activity prior to the expiry date. If you are unable to use your Voucher within the validity period, the Voucher can be extended for a period of up to six months (excluding promotions). A Voucher can only be extended once and must be done while the Voucher is valid.
Extended Vouchers cannot be refunded. A £20 administration fee is payable if you choose to extend your validity.
Choosing Your Activity
You may use your Voucher to book any of the activities from our website. If you have not already been provided with a Voucher for the type of activity you are interested in, or wish to change to another activity type, contact us on the number provided or via our website and you will be sent a Voucher for that activity. If appropriate, your original Voucher will be replaced.
Contact us again when you have decided which activity you wish to enjoy. A difference will be payable if the chosen activity costs more than the face value of your original Voucher and the value of your Voucher will be increased.
If your chosen activity is cheaper, we will hold the difference as a credit against another activity. In this case, the credit holds the same expiry date as the original Voucher.
Please note you may not be able to change your mind once a date has been booked with a supplier.
Exchanging your Voucher
A Voucher can be exchanged only once for another Voucher, up to the face value stated on it and subject to the restrictions below, without incurring a fee. An administration fee of £20 will be charged for a second and final exchange, (as no more than two exchanges in total are permitted). If you wish to combine or merge more than one Voucher together, as part of the exchange process, then this can be arranged however subject to the following restrictions; You can merge no more than two Vouchers together; if the Vouchers have different expiry dates then the earlier expiry date is taken forward onto the replacement Voucher, not the later date; only Vouchers purchased from the same retail chain or website may be merged together; and you may not merge any Vouchers previously merged or exchanged.

Bookings
In order to enjoy your chosen activity and to arrange a time and place for your activity you are asked to choose your preferred location then follow the booking instructions on the Voucher pack.
You may be required to send your Voucher to the chosen provider to confirm your booking in advance: if so we recommend you keep a record of your Voucher number and use registered post, as your Voucher is a valuable document.
Customers should also note that your Voucher must be presented on the day, in order to participate in the activity. If lost, we regret that Vouchers cannot be replaced.

Insurance
Where applicable, the price of the Voucher includes the cost of providing you with personal accident insurance cover. Refunds
If you are not satisfied with your Voucher pack, please call us within 28 days of purchase and we will happily arrange a full refund on receipt of your unused and valid Voucher. Refunds will be paid back onto your Next account. No interest will be paid on the amount to be refunded. Refunds cannot be issued once a date has been booked with the provider. We ask you to photocopy your Voucher before sending it into us or to send it via registered post, as your Voucher is a valuable document.
Personalised Item Refunds
Your rights to return the goods to us will not apply in the following circumstances:
- Any products that we have made, personalised or customised specifically for you.
- If you have made a spelling mistake on your order and it has been sent for production.
If you return an item because of an error on our part, or because it is defective, we will happily refund the full value of the item. The item(s) must be returned in the condition in which you received it within 10 days of delivery.
By the very individual nature of personalised products, they cannot be re-sold, and therefore we cannot accept returns if you have a change of mind or offer an exchange.
Activity Cheques
Activity Cheques can be redeemed for any activity or gift from our website excluding overseas activities. A difference will be payable if the chosen activity costs more than the face value of your activity cheque.
If your chosen activity is cheaper, we will hold the difference as a credit against another activity. In this case the credit holds the same expiry date as the original activity cheque.
Age,Size And Health Restrictions
For safety reasons, some activities have certain size, age and health restrictions. You are required to notify the activity provider of any relevant medical condition. Our Customer Contact Centre/or the provider can advise of any restrictions at the time of purchase and/or booking. However, you should note that you must be 18 or over to purchase any product containing alcohol.

These are given as a guide only, and you may be required to wait between different elements of the activity alongside other participants
If We Cancel Or Change Your Activity
If we cancel your activity, we will tell you as soon as possible, and do our very best to offer an alternative date or location. If specific celebrities or vehicles are featured but are not available on the day for reasons beyond our control, we will try to find the best possible replacement. If this is not possible, we reserve the right to cancel your activity at short notice and re-book you. We reserve the right to reschedule the timings or location of any activity owing to unavailability of the activity, insufficient numbers making the activity unavailable, and other factors beyond our control.
We reserve the right to discontinue an activity, venue, or individual supplier at our own discretion. We will endeavour to offer a suitable alternative activity of the same value, however, if not we will refund your Voucher in full. If you decide to book a different activity and the price of that activity exceeds the face value of your Voucher, you will be expected to pay the difference.
We also reserve the right to make minor changes to your activity. Examples of minor changes include car specification, or order of activities on a particular day.
If You Need To Cancel Or Change Your Activity Booking
You should contact us immediately if you need to change or cancel your booking. We will do our best to fill the allocated space, but if we are unable to do so, you may lose your booking. You will be advised by Next Experiences if you can rebook through the cancellation cover.
If you need to cancel your activity because of accidental injury/illness to yourself, or a death in your immediate family you should contact Next Experiences as it may be possible to re-arrange your activity on presentation of a medical or death certificate.
Weather
Activities may be cancelled due to weather conditions, mechanical failure, or for other reasons beyond our control. If your activity is cancelled because of the weather, you will be able to rebook for a date on which you are able to attend. Next Experiences is unable to reimburse travel, accommodation or other incidental expenses incurred by you in attending an activity which is cancelled for any reason.
In Case Of Problems
In case of a problem, please speak to the activity provider on the day, so they have the opportunity to resolve any problems there and then. Any other complaints should be addressed with the customer service department at Next Experiences, who will take up the problem with the supplier on your behalf.
Prices
We reserve the right to change activity prices without notice, provided we inform you before the activity is bought. Vouchers will not be issued until payment is collected in full. Prices in our printed material and on our website are inclusive of VAT.
Contracts (Rights Of Third Parties) Act 1999
A person who is not named on the face of the Voucher or activity purchase letter has no right under the Contracts (Rights of third Parties) Act 1999 to enforce any terms and conditions of booking.
These terms and conditions do not affect your statutory rights as a consumer, and are governed by and in accordance with English law. The purchaser and Next Experiences agree that any problems fall under the jurisdiction of the English courts. All the clauses and sub clauses in our terms and conditions are independent of each other. If one clause or sub clause is invalid or unenforceable, this will not affect any other clause or sub clause.

Measurements
Please check your measurements using our measuring guides to ensure that the correct sizes are ordered. All products are to fit the measurements you have provided and are made to order and orders cannot therefore be cancelled or altered once the order has been placed.
WE STRONGLY RECOMMEND THAT A FREE FABRIC SAMPLE IS ORDERED TO ENSURE THE COLOUR AND TEXTURE ARE TO YOUR LIKING as computer monitors vary greatly in colour and shade representation and are not an exact representation of the product.
Cancellations
As all items are made to order, cancellation is not possible once the order has been placed. This is due to the products' bespoke nature.
Delivery
We aim to despatch all items within 7 working days of the order being placed. We will email you when your products are despatched. Delivery is by courier at a cost of £3.99 per order. Delivery is usually during business hours. For certain areas such as Northern Ireland, Scottish Highlands and Islands, Isle of Man and the Channel Islands, delivery will take an extra day. Delivery times cannot be guaranteed.
Returns
Products are all made to order so can only be returned if faulty, or not made to the specification given. If you wish to arrange for goods to be returned, please contact customer services on 0844 844 8600. If the products are is considered faulty by Next we will at our discretion either rectify the problem or offer a full refund and you will incur no return postage costs. If the returned goods are found not to be faulty a fee for carriage will be charged at £9.95 per order (to include collection and re-delivery) and the goods will be returned to you with no credit being made to your account or refund given.
Availability
All products are subject to availability. Availability is usually advised when placing an order but if this is not possible we will advise of any delay as soon as possible.

Please read these product terms and conditions carefully as they set out the terms under which Next Domestic Appliances, (operated by DRL Ltd, trading as Next Domestic Appliances) makes the products available to you ("Product Terms").
Prices
The prices payable for the items that you order are clearly set out on the web site and in the Next Directory. All prices are expressed inclusive of any VAT payable. The price of the items does not include the delivery charge. The delivery charge is £19.99* for mainland UK (£29.99 for Northern Ireland). Prices can change and we always bring you the latest prices as quickly as possible. *Please note that there is an additional charge of £5.99 for deliveries made on a Saturday, £9.99 for next day and £2.99 for rapid deliveries (available in mainland UK only).
Product dimensions, weights, colours & specifications
It is important to note that the product dimensions do not include any protruding features such as, controls and handles etc. Product dimensions represent the casing of the appliance only.
Whilst we try to be as accurate as possible, all sizes, weights and measurements quoted on this website are approximate.
Images of the products shown on this website are for illustrative purposes only. We have made every effort to display all product colours accurately. However we cannot guarantee that the image displayed on your monitor will accurately reflect the true colour of the product delivered to you. Whilst every effort has been made to ensure that product specifications are correct on this website due to continual product development through research & design specifications may change without notice.
Availability
If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you as soon as possible. Payment will be taken for out of stock appliances to secure stock, only if you are happy to proceed with the order and agree to wait for the appliance.
Contract
There will be no contract of any kind between you and us until payment for your goods is authorised by your Next account, bank or credit card issuer. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that payment for the goods is authorised, (and not before), a contract will be made between you and us. Authority for payment must be given at the time of the order. Payment for your order will be taken once stock availability has been confirmed. If for any reason the goods can not be supplied then payment will be refunded in full. Refunds can take up to 30 days as per the Distant Selling Directive.
Delivery
Delivery will be made to the address specified by you. Please note that our standard delivery of products is within mainland UK, including the Isle of Wight. Our courier will make all deliveries to you. We do our best to secure delivery within 3-7 working days, (up to 14 working days for Northern Ireland), of the date of your order. If you order and specify items with different delivery dates, we will ship them separately and you will be charged a delivery charge each time. The cost for delivery is £19.99 (£29.99 For Northern Ireland) regardless of the number of items delivered, on a particular date. There is an additional charge of £5.99 for deliveries made on a Saturday, £9.99 for next day and £2.99 for rapid deliveries (Please note, this service is only available to UK mainland postcodes). Surcharges may apply for special deliveries where there are access restrictions. If you are not at home for a pre-arranged delivery then we reserve the right to charge you £19.99 (£29.99 Northern Ireland) agaain to redeliver your order. If you wish to change the delivery date once it is agreed then please give us no less than 3 working days notice prior to delivery. If less than 3 working days is given, an additional £19.99 (£29.99 for Northern Ireland deliveries) may be charged.
On delivery our couriers will unpack the appliance and you will be required to sign a Proof of Delivery which shall be conclusive evidence that you have received your order.
You agree to check the goods on receipt and inform us of any obvious external cosmetic damage following inspection of the goods. If there is any obvious cosmetic external damage to the goods at the time of delivery then you agree to note these on the delivery paperwork or refuse the delivery.
Signing the delivery note to accept receipt, allowing our drivers time to unpack the goods and confirming you have inspected them for any obvious external cosmetic damage are conditions of the sale and we reserve the right not to complete the delivery if you refuse these conditions. If we refuse delivery then the goods will be returned and all monies paid will be refunded.
Where any obvious cosmetic external damage has been noted on your Proof of Delivery this shall not affect your legal rights. Please refer to our Returns section for information on Non Faulty and Faulty Goods.
Subject to the other provisions of these conditions we shall only be liable for any foreseeable consequence to both of us at the time you make the relevant order. Our liability shall not in any event include pure economic loss, loss of profits, loss of business, depletion of goodwill and similar loss), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the goods.
All products are sold on the basis that they are suitable for domestic use only. Use of products for non domestic use could void your warranty.
Next day delivery
There is an additional charge of £9.99 payable for next day deliveries. In order to qualify for next day delivery, orders must be placed before 12 noon on the day before your required delivery date*. We will endeavor to get your new appliances to you the next day. When this is not possible a suitable alternative delivery date will be offered. All other Terms and Conditions apply, including those for additional services.
*Please note, next day delivery is only available on orders placed Monday to Friday. This service is available in UK mainland only.
Rapid delivery
There is an additional charge of £2.99 payable for rapid deliveries. Rapid delivery is available on selected products only. We will endeavour to get your appliances to you as soon as 2 working days. When this is not possible a suitable alternative delivery date will be offered. This service is available for mainland UK deliveries only. All other Terms and Conditions apply, including those for additional services.
Connection
You can request that our delivery team connect your freestanding washing machine, washer dryer or dishwasher. This must be done at the point of order and a charge* will be made for each item.
Connection can be carried out to an existing standard domestic appliance water connection situated within one metre of the appliances location and to a suitable existing 13 amp socket within reach of the appliance's power lead. Included in the connection will be the removal of transit brackets and a test of the appliance.
The delivery team will be unable to connect your new appliance if:
- The old machine is not disconnected.
- Any electrical/plumbing supplies needed fail the delivery team's testing or are considered unsuitable.
- Any water supply needed cannot be isolated or is unsuitable.
- Any drainage/waste facilities needed are unsuitable.
- Mechanical adjustments are required to the appliance(s) to overcome such things as water pressure problems.
- Alterations to existing plumbing and electrical wiring are required i.e. Hard Wired.
- Alterations are required to existing cupboards and cabinets.
* Connection of a freestanding washing machine, washer dryer or dishwasher to suitable existing plumbing and plug socket is £19.99 per item.
* We reserve the right to retain the connection charge if connection fails for any of the reasons mentioned above. Please note, this service is only available in mainland UK.
Recycling
You can request that our delivery team collect and recycle your old appliance. This must be done at the point of order and a charge will be made for each item**. We have a maximum pick up weight of 50Kg.
All goods for collection and recycling must be disconnected from all water, electrical and gas supply in advance of the goods being removed and free from any housing units. All appliances should be emptied and, in the case of refrigeration, products defrosted. Only like for like appliances can be collected for recycling.
Collected goods for recycling are deemed to have zero value.
** Recycling for each appliance is £9.99.
* We reserve the right to retain the collection charge if collection fails for any of the reasons mentioned above.
Please note, this service is only available in mainland UK.
Cancellation
If you wish to cancel your order we ask that you advise us at least 3 working days before your planned delivery date and you will receive a full refund.
If 3 working days notice is not given, we will not refund the delivery charge of £19.99 (£29.99 for Northern Ireland). Where the goods have been delivered to you, you may return them for up to 7 working days from the date of delivery, in line with the distance selling directive. We reserve the right to charge you to collect the goods and to charge you for any damage that may have occurred whilst the goods have been in your possession, if necessary. For further information and charges please see Returns. No goods can be returned to store for a refund - all cancellations must be processed via Next Domestic Appliances. This does not affect your legal rights.
Returns - Non Faulty Goods
If you decide to return your goods to us we do reserve the right to charge you £99.99 for collection. Refunds can only be made by the same method used for purchase.
If for any reason you need to return an item within 7 working days of receiving delivery, please call the Next Domestic Appliances customer help line (0844 844 8907) and advise a member of our team that you wish to return the product and the reason for return. We will then organise for the goods to be collected by our courier usually within 5-7 days. The charge for collecting goods is £99.99 which reflects the actual cost of collection.
Under the terms of the distance selling directive you as the customer have a duty of care for the product whilst it is in your possession. If products are damaged by you and subsequently returned, a charge will be made to repair the product to its original condition. Please be aware that where repair is not economically viable no refund will be made. Items purchased at Next Domestic Appliances cannot be returned to a Next store. Your legal rights are not affected.
Returns - Faulty Goods
Notwithstanding our Delivery condition above If, after the goods have been fitted, you find a fault; we reserve the right to request that the following steps are complied with:
- you provide written notice of the defect to us and/or telephone us quoting your order reference number within 7 days of discovering the defect ; and
- you allow us to provide an engineer, you will be contacted to arrange a house visit to inspect the goods and confirm the fault or if asked by us we will arrange for the goods to be collected from you and returned Next Domestic Appliances at the our expense for the examination to take place there.
Upon confirmation from the engineer that there is fault, and the goods do not conform to the contract, we shall at our option repair or replace such goods (or the defective part) or refund the price of such goods, whichever is considered to be economically viable by Next Domestic Appliances.
Next Domestic Appliances shall not be liable for the goods if you continue to use the goods after giving such notice to us; or alter or repair the goods without the written consent of Next Domestic Appliances.

Payment
You can pay with your Next account or any of the following Maestro, MasterCard, American Express or Visa cards. Your payment card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. It may be necessary to re-confirm your security number for data protection reasons. Payment will be taken for out of stock appliances to secure stock, only if you are happy to proceed with the order and agree to wait for the appliance.
We accept internet orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape. This means you cannot inadvertently place an order through an unsecured connection.
Liability
The following provisions set out the entire financial liability of Next Domestic Appliances (including any liability for the acts or omissions of its employees, agents and sub-contractors) to you in respect of:
- any breach of these conditions;
- any use made or resale by you of any of the goods, or of any product incorporating any of the goods; and
- any representation, statement or tortious act or omission including negligence arising under or in connection with the Contract.
All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act 1979) are to the fullest extent permitted by law excluded from the Contract.
Nothing in these conditions excludes or limits the liability of Next Domestic Appliances:
- for death or personal injury caused by Next Domestic Appliances negligence; or
- under section 2(3), Consumer Protection Act 1987; or
- for any matter which it would be illegal for Next Domestic Appliances to exclude or attempt to exclude its liability; or
- for fraud or fraudulent misrepresentation.
Subject to the above clauses:
- Next Domestic Appliances total liability in contract, tort (including negligence or breach of legal duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the Contract shall be limited to the Contract price; and
- we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at a the time you make the relevant order. Our liability shall not in any event include loss of profit, loss of revenue, loss of business, wasted expenditure, depletion of goodwill, and loss of privacy or any other claims which arise out of or in connection with the Contract.
General
These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts. If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

Delivery Schedule

Next Wall Stickers operate a 14 day policy from date of order before we can class an item as lost in transit. If your goods do not arrive once these timescales have been breached then we'll gladly re-make your order.
You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for them. We will not refund goods that are delayed in transit due to any reason, including industrial action by third parties.
If the goods we deliver are damaged or defective you must email us on help@nextwallstickers.co.uk with full details of the problem, within 10 working days of the delivery of the goods in question.
If you do not receive goods ordered by you within 30 days of the date on which you received confirmation of your order, we shall have no liability to you unless you notify us in writing at specify address including email address of the problem within 40 days of the date on which you ordered the goods.

Cancellations
Wall Sticker products that give you a choice of colour and size are custom-made to order. Cancellation is not possible after the order has been placed and accepted. If the products are considered faulty or not as described by us, we will at our discretion either rectify the problem or offer a full refund and you will incur no return postage costs.
Returns
You can only return items which are faulty, do not fit their description, or do not meet with your instructions, within 10 days in a new and unused condition. If your order is damaged in anyway once you receive it, please email us straight away and DO NOT attempt to fit the wall sticker, we will replace the damaged goods.
Guarantee
All of our products carry a 12 month warranty. We reserve the right to inspect claims under the above warranty prior to any settlement being authorised.
Colours
The colour of goods may vary slightly from that shown on the website due to limitations of browser software and monitors. All measurements are metric.
Product Installation
We cannot be held responsible for any damage to paint work/fixtures and or fittings during the process of installation/removal. Our products are classed as Do-It-Yourself with the understanding that installation is to be carried out by you the customer and we cannot be held responsible for the actions of our customers during the handling of our products. In very rare cases paint may have to be 'touched up' after removal/installation depending on the current state of your painted walls.

Delivery Schedule
All HOUSE SIGNS will be delivered within 10 working days of you receiving confirmation of your order.
You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for them.
We reserve the right to charge any delivery costs from the customer, if an item is returned to us due to failed delivery after delivery arrangements have been communicated to you.
We will not refund goods that are delayed in transit due to any reason, including industrial action by third parties.

Cancellations

Returns Policy
You must return items which are faulty, do not fit their description, or do not meet with your instructions, within 10 days in a new and unused condition. Bespoke Plaque Production
When purchasing a HOUSE SIGN the buyer agrees that the product is a bespoke product, made to the exact design, spelling and punctuation and will not be changed once confirmation of order has been sent. If the company finds inappropriate content or any copyright infringement we reserve the right to refuse production.
Colours, shapes and sizes
The colour of goods may vary slightly from that shown on the website due to limitations of browser software and monitors.
Also colour variations are likely to occur due to the nature of natural raw materials used.

Returns and Cancellation
We hope that you will be pleased with your purchase. However, should you wish to return your order in full, we will be happy to refund or exchange a product providing a request is made in writing within 7 days of receipt of goods. Next Flooring reserves the right to refuse part order returns.
N.B. If you wish to return any goods they must be complete, unused, and in "as new" condition.
If you have opened any boxes to examine the product this must have been done without damaging the packaging in any way, as the packaging is specifically designed for the product and is deemed as part of the item. Next Flooring reserves the right to refuse all returns, which fall outside these requirements.
When goods are simply unwanted or unsuitable, and conform to the details above, Next Flooring will refund the customer in full less any direct expenses Next Flooring may have incurred in fulfilling the original agreement.
Direct expenses incurred include any delivery costs whether charged to the customer or not (i.e. FREE Delivery). Deliveries are calculated by weight and delivery location. Please be assured Next Flooring work very closely with all delivery partners to maintain competitive delivery costs at all times.

Delivery Information
Next Flooring can offer a premier next day delivery service on all orders to mainland UK addresses. This premier delivery service is available on all stocked orders. However, a surcharge may apply to some Scotland addresses, solid wood flooring and some goods outsourced with the manufacturers. All orders under the £350 threshold will incur a subsidised delivery charge of £29.95 plus vat, exceptions may apply.
Next day deliveries must be placed and funds cleared by 10am. Over holiday periods next day delivery may not be possible.
Deliveries are made to the 'kerb side'. Unfortunately, due to insurance guidelines it is not the courier's responsibility to take goods into your home so please arrange for adequate help at time of delivery.
Flooring deliveries could be made on a lorry or a van. It is assumed that the delivery address will be accessible. If there is likely to be a problem, e.g. the road or area is subject to a vehicle weight or width restriction; please inform us at the time of order.
Deliveries are made from approximately 8.00 am to around 6.00pm. Requests for an estimated time of arrival on the day of delivery are strictly at the courier's discretion. We cannot make a courier contact you to advise delivery times, we can only request this.
If a courier arrives at your address and is unable to deliver on the arranged delivery date because you are not there, or there is inadequate help available, you will be liable for any additional costs incurred. ALL deliveries must be signed for.
Approximate delivery lead times will be advised at the time of order whenever possible. Next Flooring cannot be held responsible for delivery lead time schedules arranged with outside couriers, e.g. special order products dispatched direct from manufacturers.
Next Flooring will do our utmost to avoid any damage by choosing the best couriers available. However, some goods are sent direct from the manufacturer which means we have no jurisdiction over the method of delivery.
In any event, please inspect all goods immediately on delivery. For instance, this means opening tubes to check trims and glancing over (but not opening) packs of flooring for visible damage.
If you are unfortunate enough to receive a damaged item, or an item is missing, make sure it is noted on the courier's paperwork.
Damaged items should be reported within 7 days of delivery and a replacement delivery will be agreed as soon as possible.
No Liability can be accepted for costs caused by late deliveries.
Goods refused on delivery that are found to be undamaged on return to us will incur the return delivery charge where applicable.
No liability can be accepted for costs caused by late deliveries, or for any other reason. Therefore we advise against booking installers until goods have been received in good condition.
Manufacturing Fault claims
We hope you flooring is as expected and without fault. However, it is regrettable that very occasionally this may not be the case and we would like to apologise beforehand.
To avoid unnecessary delays and inconvenience to our customers it is important to complete a few checks before installation of your flooring. If these checks are completed during your installation most faults can be avoided.
It is important to check that each board is flawless before laying them. Next Flooring will not accept any claims for damaged, faulty or mis-described items once the flooring has been installed, as once installed such use or installation shall be taken as conclusive evidence the buyer has accepted that the goods are in perfect condition.
It is important that the customer checks all manufacturers specification details for suitability of purpose. It is concluded that the customer must accept full responsibility for the suitability of the goods ordered for the purpose to which they are put once the product has been installed.
If you are unfortunate enough to notice a fault in the product before installation it is requested that it is returned to us. Please see our returns policy for details of how to action this procedure. Once the goods have been returned, and confirmation has been given that there is a valid claim, a full replacement will arranged for the goods or a full refund made for those faulty goods if required. Also, if the claim is valid, a full credit is raised for the cost incurred by the customer for the return of the items (customer's courier receipt required).
If, after installation, you are unfortunate enough for the product to develop a fault arising from manufacture you may be able to make a claim. However, Next Flooring uses an independent arbitrator to assess all such claims. If you wish to proceed with an inspection Next Flooring reserves the right to charge the cost of inspection at a rate of £80.00 plus VAT. If the inspection shows that the complaint is caused by a manufacturing fault said charge will be refunded.

We will only use your email address to contact you in relation to an enquiry you have made; in the event that a problem arises; for administrative purposes or operational reasons relating to our service. The Next Experiences issues face value vouchers ("Vouchers") entitling the Holder to choose, up to the value stated on the Voucher, one of a range of activities supplied by the Next Experiences and provided by selected suppliers.
Voucher Validity
Vouchers are valid for a minimum of nine months (excluding promotions). Please check the season of any intended activity, as this may be shorter than the Voucher validity. You will find the expiry date printed on the Voucher. You must book and complete your activity prior to the expiry date. If you are unable to use your Voucher within the validity period, the Voucher can be extended for a period of up to six months. A Voucher can only be extended once and must be done while the Voucher is valid.
Extended Vouchers cannot be refunded. A £20 administration fee is payable if you choose to extend your validity.
Choosing Your Activity
You may use your Voucher to book any of the activities from our website. If you have not already been provided with a Voucher for the type of activity you are interested in, or wish to change to another activity type, contact us on the number provided or via our website and you will be sent a Voucher for that activity. If appropriate, your original Voucher will be replaced.
Contact us again when you have decided which activity you wish to enjoy. A difference will be payable if the chosen activity costs more than the face value of your original Voucher and the value of your Voucher will be increased.
If your chosen activity is cheaper, we will hold the difference as a credit against another activity. In this case, the credit holds the same expiry date as the original Voucher.
Please note you may not be able to change your mind once a date has been booked with a supplier.
Exchanging your Voucher
A Voucher can be exchanged only once for another Voucher, up to the face value stated on it and subject to the restrictions below, without incurring a fee. An administration fee of £20 will be charged for a second and final exchange, (as no more than two exchanges in total are permitted). If you wish to combine or merge more than one Voucher together, as part of the exchange process, then this can be arranged however subject to the following restrictions; You can merge no more than two Vouchers together; if the Vouchers have different expiry dates then the earlier expiry date is taken forward onto the replacement Voucher, not the later date; only Vouchers purchased from the same retail chain or website may be merged together; and you may not merge any Vouchers previously merged or exchanged.
Please note Next Experiences promotional products, tangible gift products and Weekend Gift Breaks products are excluded from the list of exchangeable products.
Bookings
In order to enjoy your chosen activity and to arrange a time and place for your activity you are asked to choose your preferred location then follow the booking instructions on the Voucher pack.
You may be required to send your Voucher to the chosen provider to confirm your booking in advance: if so we recommend you keep a record of your Voucher number and use registered post, as your Voucher is a valuable document.
Customers should also note that your Voucher must be presented on the day, in order to participate in the activity. If lost, we regret that Vouchers cannot be replaced.
Please note you may not be able to change your mind once a date has been booked with a supplier.
Description And Photography
We have tried hard to ensure that descriptions, illustrations and experience titles used in the Voucher packs, in all our literature and our website are accurate, however, photographs and experience titles are intended to give a general idea of the activity described, and do not form part of any contract between you and Next Experiences.
Please note depending on the location you choose the experience title may differ to that of experience title used by our suppliers, but this does not effect your entitlement as described in your Voucher pack.
Insurance
Where applicable, the price of the Voucher includes the cost of providing you with personal accident insurance cover. This insurance cover is only included if indicated on your Voucher and is not available for activities that take place abroad. Full details of insurance cover are included in your information pack.
Refunds
If you are not satisfied with your Voucher pack, please call us within 28 days of purchase and we will happily arrange a full refund on receipt of your unused and valid Voucher. Refunds will be paid back onto your Next account. No interest will be paid on the amount to be refunded. Refunds cannot be issued once a date has been booked with the provider. We ask you to photocopy your Voucher before sending it into us or to send it via registered post, as your Voucher is a valuable document.
Personalised Items Refunds
Your rights to return the goods to us will not apply in the following circumstances:
- Any products that we have made, personalised or customised specifically for you.
- If you have made a spelling mistake on your order and it has been sent for production.
If you return an item because of an error on our part, or because it is defective, we will happily refund the full value of the item. The item(s) must be returned in the condition in which you received it within 10 days of delivery.
By the very individual nature of personalised products, they cannot be re-sold, and therefore we cannot accept returns if you have a change of mind or offer an exchange.
Activity Cheques
Activity Cheques can be redeemed for any activity or gift from our website excluding overseas activities. A difference will be payable if the chosen activity costs more than the face value of your activity cheque.
If your chosen activity is cheaper, we will hold the difference as a credit against another activity. In this case the credit holds the same expiry date as the original activity cheque.
Age, Size And Health Restrictions
For safety reasons, some activities have certain size, age and health restrictions. You are required to notify the activity provider of any relevant medical condition. Our Customer Contact Centre/or the provider can advise of any restrictions at the time of purchase and/or booking. However, you should note that you must be 18 or over to purchase any product containing alcohol.
Activity Availability And Timings
These are given as a guide only, and you may be required to wait between different elements of the activity alongside other participants.
If We Cancel Or Change Your Activity
If we cancel your activity, we will tell you as soon as possible, and do our very best to offer an alternative date or location. If specific celebrities or vehicles are featured but are not available on the day for reasons beyond our control, we will try to find the best possible replacement. If this is not possible, we reserve the right to cancel your activity at short notice and re-book you. We reserve the right to reschedule the timings or location of any activity owing to unavailability of the activity, insufficient numbers making the activity unavailable, and other factors beyond our control.
We reserve the right to discontinue an activity, venue, or individual supplier at our own discretion. We will endeavour to offer a suitable alternative activity of the same value, however, if not we will refund your Voucher in full. If you decide to book a different activity and the price of that activity exceeds the face value of your Voucher, you will be expected to pay the difference.
We also reserve the right to make minor changes to your activity. Examples of minor changes include car specification, or order of activities on a particular day.
If You Need To Cancel Or Change Your Activity Booking
You should contact us immediately if you need to change or cancel your booking. We will do our best to fill the allocated space, but if we are unable to do so, you may lose your booking. You will be advised by Next Experiences if you can rebook through the cancellation cover.
If you need to cancel your activity because of accidental injury/illness to yourself, or a death in your immediate family you should contact Next Experiences as it may be possible to re-arrange your activity on presentation of a medical or death certificate.
Weather
Activities may be cancelled due to weather conditions, mechanical failure, or for other reasons beyond our control. If your activity is cancelled because of the weather, you will be able to rebook for a date on which you are able to attend. Next Experiences is unable to reimburse travel, accommodation or other incidental expenses incurred by you in attending an activity which is cancelled for any reason.
In Case Of Problems
In case of a problem, please speak to the activity provider on the day, so they have the opportunity to resolve any problems there and then. Any other complaints should be addressed with the customer service department at Next Experiences, who will take up the problem with the supplier on your behalf.
Prices
We reserve the right to change activity prices without notice, provided we inform you before the activity is bought. Vouchers will not be issued until payment is collected in full. Prices in our printed material and on our website are inclusive of VAT.
Contracts (Rights Of Third Parties) Act 1999
A person who is not named on the face of the Voucher or activity purchase letter has no right under the Contracts (Rights of third Parties) Act 1999 to enforce any terms and conditions of booking.
These terms and conditions do not affect your statutory rights as a consumer, and are governed by and in accordance with English law. The purchaser and Next Experiences agree that any problems fall under the jurisdiction of the English courts. All the clauses and sub clauses in our terms and conditions are independent of each other. If one clause or sub clause is invalid or unenforceable, this will not affect any other clause or sub clause.

General
At Next Garden Plants we guarantee only to send you top notch plants, products and gifts and will inspect everything carefully before it leaves us to make sure it's in tip top condition. We also do our utmost to package and protect everything so that it doesn't get damaged on its way. However, if you do have a problem, here is what to do:

Incorrect Goods
If we sent you something you hadn't ordered and which was not a substitute item (see below), please contact us within 7 days informing us of the problem. You can return it within 28 working days unused in its original packaging and you will not be charged.
Damaged In Transit
If your purchase is damaged in transit, please contact us within 7 days informing us of the problem. You can return it within 28 days and either get a replacement or a refund. Please make sure you give us your order number and return the item in its original packaging.
Damaged or Defective Plants
If you receive a plant that is in bad condition when you take it out of the box, contact us immediately. We will then ask you to send us a photograph so that there is no doubt as to it's condition on arrival with you, as opposed to what it looks like by the time you return it to us. Bear in mind that plants look different depending on what time of year it is. If you choose a nice leafy-looking deciduous shrub in the winter, remember it's going to turn up looking pretty bare. It doesn't mean there's anything wrong with it, just that it's out of season and will perk up when the weather does. Perennial plants won't even show above the soil level in a pot during the winter, but that doesn't mean you've been fobbed off with a bunch of soil. However, provided that you have contacted us within 7 days of receiving the defective plant we will be happy to arrange for a refund or replacement once we have received the pictures and determined the cause of the problem.
One year Guarantee on Plants, shrubs, trees and perennials
Our plants (all fully hardy shrubs, trees and perennials, excluding annuals and biennials) are all guaranteed for one year after you've bought them. If the plant fails in the first 12 months, send us a picture of the plant along with your order reference number to plants@next.co.uk. Once we have determined the cause of the problem we will endeavour to replace it or refund you. This guarantee does not include any plants damaged due to lack of watering or lack of proper horticultural care. In particular, plants will not be replaced if the plant care guidelines, sent out with the order, have not been followed. You will be charged for delivery on replacement items.
Cancellation
To cancel an order, please drop us an e-mail at plants@next.co.uk with details of the order you are cancelling. A charge may be made if the cancellation is done after the order or a part of the order has been dispatched.
Substitutes
If you order a Ready-Made Border, Plant Combination or Border Design and a plant in the scheme is unavailable, we reserve the right to replace it with something similar. You can rely on us to choose a plant that's not only of a comparable size and price but one that fits in with the overall design we've worked on with you.

Cancellation Rights For Temporary Blinds
You have the right to cancel your order within seven working days beginning the day after the day on which you receive the goods. If you wish to cancel this contract you must indicate this in writing or email to Next Shutters supplier (Premier Shutters Ltd, 15 Braiswick Place, Laindon,
Basildon, Essex, SS15 6EB, info@premiershutters.co.uk within the cancellation period.
You have a statutory duty to take reasonable care of the goods while in your possession. You must arrange for the safe return of goods to Premier Shutters Ltd,
the cost of which is to be born by you, failing which Premier Shutters Ltd will recover the goods, the cost of which will be deducted from any refund due to you.
On the cancellation of a contract the supplier shall reimburse any sum paid (less any charge made in connection with recovery of the goods)
within 30 days of cancellation.
Where goods do not conform to the implied terms set out under the Sale of Goods Act 1979 the cost of recovering the goods will be borne by Premier Shutters Ltd.
Payment
All payments are required to be made as follows: 50% at time of order and the remaining balance on completion of the installation/or delivery as per the Sales order
Confirmation.
Defective Goods
If on delivery any of the Goods are defective in any material respect and either the Customer lawfully refuses delivery of the defective Goods or, if they are signed for on
delivery "condition and contents unknown" the Customer gives written notice of such defect to the Supplier within three business days of such delivery, the Supplier shall at its option:-
1 replace the defective Goods within 56 days of receiving the Customer's notice; or
2 refund to the Customer the price for the goods which are defective or
No Goods may be returned to the Supplier without the prior agreement in writing of the Supplier. Subject thereto any Goods returned which the Supplier is satisfied were supplied subject to defects of quality or condition which would not be apparent on inspection shall either be replaced free of charge or, at the Supplier's sole discretion the Supplier shall refund or credit to the Customer the price of such defective Goods but the Supplier shall have no further liability to the Customer.
Right to Return the Goods and to Receive a Refund
If the Customer is not satisfied with any Goods purchased from the Seller, the Customer may cancel the Contract and return the Goods to the Seller and obtain a refund of the price of the returned Goods, provided The Customer informs the Seller of the decision to cancel the Contract within 5 Calendar Days of delivery of the Goods; and The Goods are returned in their original condition
The following transportation charges will apply:-
If the total purchase price of the returned Goods is less than £250 the charge payable by the Customer for the return is £20.
If the total purchase price of the returned Goods is more than £250 the charge payable by the Customer for the return is £80.
Where the Goods are custom made to the order of the Buyer, the Buyer shall not be entitled to return the Goods and receive a refund unless the Goods are faulty. The
statutory rights of the Buyer are unaffected.

RETURNS : Please do not return Beaverbrooks products to Next with your courier or to Next stores. You will be sent detailed returns information with your Beaverbrooks product. To return, please use the pre-paid returns label provided. You can return Beaverbrooks products up to 30 days after receipt of your order. Beaverbrooks products cannot be returned to Next with your courier or to a Next store. Failure to return Beaverbrooks products direct to Beaverbrooks will delay any refund to your Account.

A. Descriptions, prices and product information
We have taken care to describe and show typical products as accurately as possible. We provide only basic product information and example installations on the Next Conservatories site. B. Availability
We try to ensure that we can always produce products from the full product range. If for any reason beyond our reasonable control we are unable to supply a particular item and you choose to continue with the remainder of any order we will not be liable to you except to ensure that you are not charged for that item.
C. Survey, Quotation and Order acceptance
All of the products that Next Conservatories supply are made to measure specifically to suit your home. If you request a quotation we will arrange for one of our measurement surveyors to visit you at your convenience. It may be necessary for our surveyor to remove trims/render from the perimeter of certain frames to carry out a detailed survey. Our surveyor will advise you if this is needed prior to doing so and will make every effort to minimise the damage. The survey detailing your requirements will be returned to our head office. We will then send you a written postal quotation for the manufacture and installation of the products you have chosen based on the surveyor’s report. You will then have 30 days from the date of our quotation to return a signed copy of our purchase order to us with your deposit indicating that you wish to go ahead with the purchase. The specific terms and conditions of sale are shown on the reverse of the customer purchase order that we will send to you.
D. Delivery
We will endeavour to install your Conservatory, Doors or Windows within your chosen delivery period. However the delivery period is only an estimate and may be affected by factors both inside and outside our control. Time is not however of the essence of any order that you place with us and the specific terms and conditions relating to our delivery estimates and remedies if we exceed the estimated delivery period are detailed on the reverse of our customer purchase order.
E. Cancellation of order
We will send you a written quotation following our surveyor’s visit and you will not be obligated to purchase anything from us until you return a signed copy of our purchase order with your deposit and authorisation that we can commence manufacture. The purchase order will also contain a cancellation slip and you may still cancel your order without penalty in the seven days following the date you signed and returned the order confirmation to us. If you cancel outside of this seven day period, manufacture may have commenced and you will be responsible for any costs that we have incurred in producing bespoke products which are suitable only for your home and which cannot then be sold to others.
F. Refund policy
If you cancel your order within seven days of returning the signed purchase order to us we will refund any deposit you have paid in full.

Next Conservatories accepts MasterCard, Visa credit and debit and also Switch and Maestro debit cards. Unfortunately we do not accept American Express, Solo or Diner’s Club credit cards.

Terms and Conditions for Entry to the Next Fashion Friend Competition 2012
This competition is open to residents of the United Kingdom, Channel Islands, Isle of Man and Republic of Ireland, except employees of Next Group plc (including Directory, Store and Head Office staff), their families, employees of LOOK Magazine, or any other company professionally associated with the competition.
It is a condition of entry to the competition that these rules are accepted as final and that the Entrant and Fashion Friend agree to abide by these rules.
Entrants and Fashion Friends must be aged 18 or over.
To Enter the Competition, Entrants must complete all compulsory fields on the Official Online Entry Form found at www.nextfashionfriend.com and confirm agreement to all terms and conditions, verify age, upload a picture and submit the Entry. For any content that you submit, you grant Next a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.
Next's decision is final and no correspondence will be entered into. The Winners' name and region of residence can be obtained for any draw by sending a stamped addressed envelope to Wear it, Wave it, Win with it Prize Draw Winner, Press Dept - Phase 1, Next Plc, Desford Road, Enderby, Leicester LE19 4AT. You must specify which particular prize you wish to obtain the winners details for.
The prize is as described and is non transferable. There is no cash alternative.
Events may occur that render any of the prize draws or the awarding of the prize impossible due to reasons beyond the control of Next and accordingly Next may at its absolute discretion vary or amend the prize draw and the Entrant agrees that no liability shall attach to the promoter as a result thereof.
We reserve the right to apply the value of any of the prizes offered to any outstanding account(s) of Next Group Companies. The prize draws may be offered across other Next Plc group promotions.
